Last Thursday, July 5, the Chamber of Deputies initiated a complementary bill (PLP 68/24) that, after 40 days of intense debates, aims to create a new consumption tax system. One of the main novelties of the project is the introduction of the figure of the nanoentrepreneur.
The project proposes to exempt nanoentrepreneurs from the Contribution on Goods and Services (CBS) and the Tax on Goods and Services (IBS) if their annual revenue does not exceed R$40.5 thousand (approximately R$3.38 thousand per month). This benefit aims to stimulate small businesses and alleviate the tax burden of microentrepreneurs.
The new category would benefit approximately five million Brazilians who currently qualify as Individual Microentrepreneurs (MEIs) with an annual revenue limit of R$81,000. With the change, these professionals would have an even lower tax burden.
If the project is approved, nanoentrepreneurs will not have to pay CBS and IBS, which together form the Value Added Tax (VAT), as long as their annual revenue is up to R$40,500. This category would include people with monthly revenue of up to R$3,375, equivalent to 50% of the MEI limit.
The tax exemption would especially benefit those who supplement their income with smaller activities and do not find it advantageous to formalize themselves as MEI. In addition, formalization as a nanoentrepreneur could facilitate access to credit lines, which is currently difficult for those who are not formalized.
Today, MEIs pay a single monthly fee under Simples Nacional, ranging from R$70.60 to R$76.60, depending on the activity. Under the new project, nanoentrepreneurs will be able to choose between remaining in Simples Nacional or migrating to IVA.
Despite the benefits, it is still necessary to define whether nanoentrepreneurs will have the same social benefits as MEIs, even without paying taxes. If this is decided, the government will need to find another source of resources.
The nanoentrepreneur bill still needs to go through more stages before being sanctioned. For approval in the Chamber, at least 257 votes in favor are required. The vote is scheduled for next week, before the parliamentary recess, on July 18.
